Yesmail Must Pay $50,000 Penalty to Settle Can Spam Complaint

The Federal Trade Commission has levied a $50,717 civil penalty on Yesmail Inc. as part of settlement involving a Can Spam e-mail list regulatory complaint.

According to the complaint Yesmail distributed e-mail on behalf of clients 10 days after the recipients unsubscribed from e-mail lists. The FTC alleged Yesmail sent thousands of e-mails and failed to honor opt-out requests that it received.

The settlement permanently prohibits Yesmail from violating the Can Spam Act. It requires Yesmail to maintain a functioning e-mail address or other Internet mechanism for consumers to decline future e-mail.

The complaint and subsequent settlement agreement were filed at the U.S. District Court for the Northern District of California.
