FTC Seeks Comments on Possible MO Rule Renewal/Expansion

The Federal Trade Commission has begun seeking comments on whether to retain and/or expand its mail order rule.

In a Federal Register notice filed Wednesday, the FTC said it’s seeking information on the rule’s costs and benefits. The Commission also seeks to determine whether it should make three changes to the rule in response to technological and marketing changes that have occurred since the Rule was last updated in 1993.

Simply put, those changes involve:

*Expanding the definition of the telephone to include the Internet.

*How to treat newer payment methods such as demand drafts and debit cards that have emerged since 1993.

*Whether the FTC should give merchants more flexibility in making refunds, which now must come via first class mail.

The FTC is accepting comments until Nov. 7.
