Amazon.com And The New York Times Settle Lawsuit

Posted on by Chief Marketer Staff

Amazon.com and The New York Times have settled a lawsuit over the online bookseller’s references to the Times’s Best Sellers list as part of Amazon.com’s half off list price program.

Under the agreement, Amazon.com will continue to use The New York Times Best Sellers list and will supply the Times with sales data. The list will be posted alphabetically and only after the Times has made it available to the general public. In addition, Amazon.com will have to include a disclaimer that the Times is neither affiliated with nor endorses Amazon.com.

The Times filed suit against Amazon.com’s use of the list on May 28, claiming a violation of its intellectual property. Amazon.com filed a countersuit on June 4 seeking to use the list without the Times permission.
