Heavy Metal band Slipknot has filed a cease and desist order against Burger King Corp. and its ad agency Crispin Porter + Bogusky as an attempt to remove a TV spot from the airwaves.
Last month, the Iowa-based band filed the letter against the QSR, alleging that the Burger King’s manufactured metal band Coq Roq resembles Slipknot, according to news reports.
In the cease-and-desist letter, Howard Weitzman, the band’s attorney, wrote that Burger King’s fake band is dressed similarly to Slipknot— to the gas mask, kabuki-style mask and a mask with dreads worn by Slipknot members, reports said.
Weitzman said Burger King contacted the band in September 2004 to recruit it for an advertising campaign to motivate young adults to vote, but the band rejected the offer, according to reports.
Burger King, however, fought back, filing a lawsuit Aug. 12 against the band and its merchandising company in U.S. District Court in Florida. The lawsuit asks the court to declare that its use of a fake metal band wearing chicken masks doesn’t violate Slipknots rights.
The QSR launched the ad to promote its new chicken fries product (PROMO Xtra July 26).
