[PROMO Xtra] A small Internet service provider has filed a federal lawsuit against Kraft Foods alleging the food company uses spam to market Gevalia coffee. The suit, filed Monday in U.S. District Court in San Francisco, charges Kraft and its Victor Th. Engwall & Co. subsidiary with sending 8,500 unsolicited e-mail ads to customers of Hypertouch, the Foster City, CA-based ISP.
Hypertouch contends that Northfield, IL-based Kraft and White Plains, NY-based Engwall have been spamming consumers via third-party e-mail services since 2001. The suit seeks a jury trial and damages of $11.7 million.
Hypertouch tested Gevalia’s opt-out link by submitting a never-used e-mail address, then “started getting daily spam for all kinds of products and services,” said Hypertouch President Joe Wagner in a statement.
Kraft did not return a call for comment.
