Virtumundo Claimed Lists It Rented Not Opt-In

Direct marketing company Virtumundo Inc. said Tuesday it had filed lawsuits against Mindset Interactive Inc. and Inurv Inc., for mis-representing the “permission-based” nature of the lists they provided.

In its claim Virtumundo, Kansas City, MO, alleged that a number of consumers on the lists had not agreed to accept e-mail ads from Mindset or Inurv and so had not given the companies permission to sell their data.

The complaint further alleges that Mindset and Inurv said that consumer data was collected with consumer consent. Finally, the databases contained thousands of e-mail addresses that did not exist, according to Virtumundo.

Neither Mindset Interactive nor Inurv could be immediately reached for comment.
