Texas Reaches Settlements With Three Telemarketers

Settlements with three companies and Greg Abbott attorney general of Texas have been reached in the District Court of Travis County Texas involving violations of state telemarketing law, which prohibits companies from calling consumers on the state’s no-call list.

Texas obtained a final judgment and permanent injunction against Dallas based On Wheels Computer Repair Service, which admitted it had obtained the state’s no-call list, but continued to make outbound calls, even after it received a warning from Abbott. On Wheels agreed to pay a $10,000 civil penalty and $3,000 in attorneys’ fees and investigative costs.

A to Z Movers of Dallas and Amerigroup Mortgage Corp. of St. Petersburg, FL reached binding “assurance of voluntary compliance” agreements with the state to use the no-call list.

A to Z Movers used an automated dialer to deliver prerecorded messages to consumers on the no-call list. A to Z must pay $5,000 in civil penalties and reimburse the state for $2,000 in attorneys’ fees.

Mortgage Investors which admitted no liability agreed to pay $7,500 in civil penalties, in addition to another $7,500 in attorneys’ fees and investigative costs.
