FEDMA Protests EC’s Data Transfer Contract Clauses
FEDMA, the European lobbying group, has criticized the decision of the European Commission to mandate standard contractual clauses for transfer of personal data to third countries.
In a meeting with Ulf Bruhann, head of the EC’s data protection unit, FEDMA officials argued that the “model contract clauses,” which promise privacy protections, are difficult to implement, and that they present legal risk and administrative cost to direct marketers.
FEDMA wants assurances that the model contracts will not affect the validity of existing contracts, and that it also insists that the EC verify that the model clauses represent a maximum rather than minimum level of protection.
“The debate has so far not been very inclusive, and we hope this meeting will change this situation so that we can participate more constructively in the debate that will follow,” said Axel Tandberg, FEDMA’s public affairs director, in a statement.
