Opt-in e-mail marketing services provider NetCreations Inc., New York, reached a settlement earlier this week with a company it sued suing for trademark infringement. Terms of the settlement were not disclosed.
The lawsuit, filed March 30 in U.S. District Court for the Southern District Court for the Southern District of New York, charged that direct marketing company eData.com Inc., Boca Raton, FL, had used the name Postmaster for its e-mail business and engaged in trademark infringement and unfair competition. NetCreations, which calls its opt-in e-mail business, PostMasterDirect, believes it has exclusive rights to the name “Postmaster”for matters related to e-mail marketing, said Brian Burlant, NetCreations lawyer.
NetCreations filed another, unrelated trademark suit in the same court against Postmaster Network, Pompano, FL on July 21. That suit is still pending.
