Lands’ End German Subsidiary Files Complaint With EU

Lands’ End Inc.’s German subsidiary has filed an official complaint with European Union regulators against a German ban on advertising unconditional guarantees, the Wall Street Journal reported.

Lands’ End says the German law is illegal under EU laws mandating free trade in goods and services. The company offers its unconditional money-back guarantee in the United Kingdom and 174 other countries worldwide.

The filing follows months of frustration for the Dodgeville, WI-based cataloger, after a German court found that Lands’ End’s advertisements misled consumers. The decision is based on a 1930s German law that bans bonuses because they make it difficult for people to compare prices.

A German government spokesman says the government is planning to do away with the law, according to the report. Lands’ End may continue advertising the guarantee for the time being.
