FTC Settles Can Spam Case

The Federal Trade Commission has settled a lawsuit it filed that accused two individuals of violating Can Spam e-mail list regulations.

The settlement with Matthew Olson and Jennifer LeRoy, both of Washington State, includes a $45,000 suspended judgment, which would be re-imposed if they were found to be misrepresenting their inability to pay. The FTC has filed for a permanent injunction against the pair at the U.S. District Court for the Western Division of Washington, located in Seattle.

The case involved the alleged hijacking of consumers’ computers to distribute illegal e-mail promotions, which concealed the name of the real sender with misleading subject lines and failure to provide an opt-out mechanism and a physical address.

Millions of e-mails were sent to promote mortgages, a device for improving gas mileage and other products, according to the FTC.
