The value of these businesses stems from the know-how, programs and raw data that have been put together by key personnel.

As we speak, my firm represents a formidable affiliate marketing enterprise. The principals have put years of blood, sweat, tears and money into getting to where they are. Only to find out one day, that their former right-hand man threatens to bring it all down…

Our client’s senior executive, who uses pseudonyms, “Jack Smith” and “Jeff Foss,” embedded script in our client’s third-party and proprietary software in order to, among other things, copy millions of user records and send those records to companies he and cohorts had established – of course, to use for his own power. Jack’s cohorts go by the pseudonyms “Steve Nair,” “Sam Nair,and Steve Winsent.” Their illegally competing companies are called “Skayans Marketing” and “GoNimble Technologies Pvt., Ltd.

These individuals have cost jobs, put a black eye on the industry, and deprived good people of untold profits by using our client’s hard work for their own gain. It’s fraudulent and it’s repugnant.
