GlobeDIrect Denied Injunction Against Former Employees

GlobeDirectLLC has had its request for an injunction against several former employees rejected by the Middlesex Superior Court. In February, GlobeDirect alleged that several former employees stole work histories, customer lists and internal documents, and enticed GlobeDirect clients to work with Kirkwood Direct, a company formed in December 2006 that employs the former GlobeDirect workers.

In rejecting GlobeDirect’s request, the court stated that the company “failed to establish a likelihood of success on the merits” of the complaint, according to a statement from Kirkwood Direct.

“We are gratified, but not surprised, by the Court’s ruling,” said Kirkwood Direct’s president and general manager Stephan Duncan, in a statement. Duncan was one of the employees named in GlobeDirect’s request.

In its initial complaint, GlobeDirect alleged Kirkwood Direct was formed to “provide business with turnkey direct marketing products and services including strategy, printing, data management, data acquisition, letter shop, fulfillment/kitting, postal processing, logistics, media planning and media buying.” GlobeDirect further claimed that, “the solo mail aspect of Kirkwood Direct’s business would be virtually indistinguishable from GlobeDirect’s.”

GlobeDirect also alleged that several of its clients were solicited to send their work to Kirkwood Direct.
