Patent Owner Files Infringement Suit Against DMers and Others

Andrea Rosengard, the inventor and owner of a computer system for personalized fashion shopping has filed a patent infringement suit against a number of companies including Lands' End, JC Penney and Federated Department Stores, Inc.

The suit, filed on Oct. 18 in the U.S. District Court, Southern District of New York0, seeks a permanent injunction and unspecified damages. The patent, entitled System and Method for Fashion Shopping, was granted in July 1999.

Other companies named in the suit are Public Technologies Multimedia, Inc. (Montreal, Quebec, Canada), Mattel, Inc., Delaware, Broderbund Software, Inc., Delaware and The Hearst Corp, New York, NY.

The StyleFitter computer system helps consumers select appropriate clothing for their body type by allowing them to "try on" apparel via virtual modeling.

Rosengard is founder, chairman and CEO of Fashion Integration Technology in New York.

The suit was filed by New York law firm Fish & Neave.
