The Attorney General of West Virginia has filed suit against Norfolk Pharmacy, Weirton, alleging the illegal advertising, sale, prescription, and distribution of prescription drugs over the Internet.
AG Darrell V. McGraw's lawsuit claims the Norfolk Pharmacy and the Norfolk Men's Clinic of selling such drugs as Viagra, Propecia, Xenical, Celebrex, and Claritin to its customers without valid prescriptions written by a doctor. Both NMC and Norfolk Pharmacy have been enjoined from conducting business.
Filed in Hancock County Circuit Court, the civil lawsuit accuses the Clanton, AL-based clinic of illegally charging customers $20 for a consultation fee with a doctor for the drug orders, above the cost of the drugs as well as shipping and handling. The suit alleges the pharmacy pocketed the fees and forged the signature of a Romanian doctor. The prescriptions were filled and shipped from Weirton.
McGraw's suit claims that the value of Norfolk's filled prescriptions for 1999 is $54.6 million, if not more.
