Former Metromail Corp. vice president Thomas Hupp is fighting a legal battle against employers Metromail and Experian Corp. to recover severance pay following an alleged demotion and his subsequent resignation.
The lawsuit, filed in March in the United States District Court, Northern District of Illinois, asks to award Hupp 12 months of severance pay, including his base salary of $150,000, plus his annual bonus and attorney’s fees and costs, according to court documents.
In a recent action, Orange, CA-based Experian filed a motion to dismiss the complaint. Hupp’s response is due next week.
“We’re confident in the facts and in our position,” said Marcia Topper Wolf, an attorney representing Hupp in the case.
Calls to Experian were not returned by press time.
According to the complaint, Hupp was demoted from vice president of operations and technology of online services to vice president of operations and technology of NDA, following Experian’s acquisition of Lombard, IL-based Metromail in April 1998. Hupp claims that at the direction of Experian management, his responsibilities were reduced. Hupp, who had been hired by Metromail in May 1997, resigned in September 1999, the complaint continued.
