Heineken Files Trademark Suit Against Scott’s Brewery Collectibles

Do you own one of those Heineken neon clocks from Scott’s Brewery Collectibles?

Heineken USA Inc. has decided that these novelties, which are sold online and through stores, violate its trademark. And it has sued the Chicago-based collectibles firm, demanding a permanent injunction and damages.

The suit, filed on Oct. 22 with the U.S. District Court for the Northern District of Illinois, charges that Scott’s has used “exact replications” of the Heineken mark or “confusingly similar variations” in clocks sold in interstate commerce.

The brewer also alleges that its reputation is being harmed by Scott’s advertising, and that the “unauthorized” products mislead the public.

Heineken also contends that Scott has violated Illinois laws barring deceptive trade practices.

Heineken is demanding treble damages and that Scott stop selling the products and turn over all copies.

Scott’s had not filed an answer at deadline.
